1. Acceptance of Terms
By using ReservDM services, you agree to these Terms of Service, our Privacy Policy, and any additional service agreements. If you do not agree to these terms, you should not use our services.
This agreement is made between you and Harun Öztürk, operating as ReservDM (hereinafter "ReservDM" or "we").
2. Definitions
Terms used in this agreement:
• "Service": All software, applications, APIs, and support services provided by ReservDM • "User": Individual person or business representative using the Service • "Account": User account created to access the Service • "Business": Legal entity or sole proprietorship using the Service commercially • "Customer Data": Data uploaded to or processed through the Service • "Subscription Period": Monthly or annual payment cycle
3. Service Description
ReservDM is a Software-as-a-Service (SaaS) platform providing comprehensive appointment management solutions.
3.1 Core Services • Phone Verification: phone-number verification for online bookings • Appointment Management: Calendar, conflict prevention, and time zone management • Automated Reminders: email notifications • Customer Database: CRM features and customer history • Reporting: Revenue, performance, and trend analytics • Multi-Branch: Centralized management and branch-level reporting
3.2 Additional Features (Plan Dependent) • API access and custom integrations • Advanced analytics and data export • Priority technical support • Custom training and onboarding
4. Account and Registration
4.1 Account Creation • You must be 18 years or older • You must provide accurate and current information • You must be an authorized representative for business accounts • One person may create only one account
4.2 Account Security • You are fully responsible for account security • Use a strong password and keep it confidential • We recommend enabling two-factor authentication (2FA) • Report unauthorized access within 24 hours
4.3 Account Suspension We may suspend your account for: • Non-payment • Violation of terms of service • Suspicious or fraudulent activity • Legal requirements
5. Subscription and Payment
5.1 Pricing • Current prices are published on our website • Prices may exclude applicable taxes • Price changes take effect in the new billing period • Existing subscribers keep their rate until period end
5.2 Billing • Monthly or annual subscription options • Discounts apply to annual payments • Invoices are issued at the start of each period • Auto-renewal is enabled by default
5.3 Payment Methods • Credit/debit card • Bank transfer (annual plans only) • 7-day grace period for failed payments
5.4 Late Payment • Service is suspended for non-payment • Account may be deleted after 30 days • Data can be backed up before deletion (upon request)
6. Cancellation and Refund Policy
6.1 Cancellation • Cancel at any time • Cancellation is effective at period end • Service continues for the remaining period • Data is retained for 30 days after cancellation
6.2 Refund Terms • Annual plans: full refund within first 30 days • No partial refunds after the refund period • Refunds processed within 10 business days
6.3 Account Deletion • Request from account settings • All data deleted within 30 days • Deletion is irreversible • Some data may be retained for legal obligations
7. Acceptable Use Policy
When using our services, you must comply with these rules:
7.1 Prohibited Activities • Illegal activities • Spam or unsolicited bulk messaging • Deceptive or misleading content • Infringement of intellectual property rights • Distribution of malware or harmful code • Unauthorized system access attempts • Interfering with other users' service • Reverse engineering or decompiling
7.2 Data Usage Rules • Only lawfully obtained data may be uploaded • Your customers' consent must be obtained • Sensitive personal data requires special protection
8. Availability and Support
8.1 Availability • We aim for high availability but do not commit to a specific uptime percentage • Scheduled maintenance excluded (notified in advance) • Force majeure events excluded
8.2 Outage Notification • Scheduled maintenance: advance notice where possible • Emergency maintenance: notified as soon as possible • Outages are communicated through our support channels
8.3 Support Response • We aim to respond to support requests within 24 hours
9. Intellectual Property Rights
9.1 ReservDM's Rights • ReservDM brand, logo, and designs are company property • Software and source code are company property • Documentation and training materials are protected • These rights are not licensed; only usage rights are granted
9.2 User License • You receive a non-exclusive, non-transferable usage license • License is valid during subscription period • Commercial use is permitted (for your own business) • Sublicensing is prohibited
9.3 Customer Data Ownership • Data you upload belongs to you • You have the right to export your data • Your data is completely removed upon account deletion
10. Privacy and Data Security
10.1 Data Protection • Your data is processed according to our Privacy Policy • GDPR compliance is ensured • Data Processing Agreement (DPA) available upon request
10.2 Data Security • Industry-standard encryption is used • Regular security audits are conducted • Security incidents are reported within 72 hours
10.3 Customer Data Processing • We act as data processor on your behalf • We process according to your instructions • We use data only for service provision
11. Limitation of Liability
11.1 Warranty Disclaimer The service is provided "as is". We do not provide express or implied warranties regarding: • Uninterrupted or error-free operation • Fitness for a particular purpose • Performance of third-party services
11.2 Liability Limitations We are not responsible for: • Indirect, incidental, or consequential damages • Loss of profit or business interruption • Data loss (backup responsibility is the user's) • Damages caused by third-party actions
11.3 Maximum Liability Our total liability shall not exceed the total amount you paid in the last 12 months.
11.4 Exceptions These limitations do not apply to: • Intentional misconduct or gross negligence • Unauthorized disclosure of personal data • Death or personal injury
12. Indemnification
You agree to defend and indemnify us against claims, lawsuits, and costs arising from:
• Violation of these terms • Violation of laws • Infringement of third-party rights • Claims arising from user content
13. Service Changes
13.1 Feature Changes • We reserve the right to improve or modify features • Significant changes notified 30 days in advance • Alternatives provided when features are removed
13.2 Price Changes • Price increases notified 30 days in advance • Current period is not affected • You may cancel if you disagree with changes
13.3 Terms Changes • We reserve the right to update these terms • Significant changes notified by email • Continued use means acceptance of changes
14. Termination
14.1 Termination by User • You may close your account at any time • Export your data before closing • Remaining payment obligations continue
14.2 Termination by ReservDM • Right to immediate termination for serious violations • Termination for non-payment • Termination for legal requirements • Reasonable notice provided before termination (except emergencies)
14.3 After Termination • Service access ends • Data retained for 30 days (for export) • Unpaid amounts are collected • Confidentiality obligations continue
15. Dispute Resolution

15.3 Governing Law • This agreement is governed by applicable laws • Courts have jurisdiction as per applicable regulations
16. General Provisions
16.1 Entire Agreement These terms, Privacy Policy, and any additional agreements constitute the complete agreement between parties.
16.2 Severability If any provision is found invalid, other provisions remain in effect.
16.3 No Waiver Failure to exercise a right does not constitute waiver of that right.
16.4 Assignment You may not assign this agreement without our written consent.
16.5 Force Majeure We are not responsible for delays or failures caused by events beyond our control (natural disasters, war, pandemic, etc.).
